Santamaria Family Therapy Inc. alleges 1Recovery uses trademark

Trademark 08

LOS ANGELES – A Los Angeles provider of behavioral and mental health services alleges a Venice competitor is using a similar mark.

Santamaria Family Therapy Inc., doing business as One to One Treatment, filed a complaint on Oct. 6 in the U.S. District Court for the Central District of California against Lynne Pedersen and 1Recovery, also known as One Recovery, alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it suffered damages from having its "One" trademark used by the defendants. The plaintiff holds Pedersen and 1Recovery responsible because the defendants allegedly kept on using the mark despite cease and desist letters from the plaintiff.

The plaintiff requests a trial by jury and seeks actual, general and compensatory damages, all legal fees and interest, deliver up for destruction all infringing materials, restitution and disgorgement, punitive and exemplary damages and any other relief as the court deems just. It is represented by Wayne W. Call, David R. Sugden, Scott P. Shaw and Deborah A. Gubernick of Call & Jensen in Newport Beach.
