Woman alleges employer interfered with right to take FMLA leave to care for parent

SAN DIEGO – A woman alleges her employer denied her the right to take a federally protected leave of absence.

Roberta L. Vinson filed a complaint on Oct. 11 in the U.S. District Court for the Southern District of California against Department of Homeland Security Secretary Jeh Charles Johnson alleging violation of the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that her request for leave to take time for her father's heart valve replacement and bypass surgery in San Francisco in 2011 was interfered with. The plaintiff holds Johnson responsible because the defendant's agency allegedly failed to adequately inform plaintiff of her FMLA rights and was denied a benefit to which she was entitled.

The plaintiff requests a trial by jury and seeks compensatory and liquidated damages of $50,000, interest, attorney's fees and costs. She is representing herself.
