LOS ANGELES – An Arkansas nonprofit has filed a class-action lawsuit against a Maryland business over allegations it sent junk faxes.

ARcare, doing business as Parkin Drug Store, filed a complaint on behalf of all others similarly situated on Oct. 13 in the U.S. District Court for the Central District of California against Qiagen North American Holdings Inc. alleging violation of the Telephone Consumer Protection Act and the California Junk Fax Law.

According to the complaint, the plaintiff alleges that in May it received unsolicited fax advertisements. The plaintiff holds Qiagen North American Holdings Inc. responsible because the defendant allegedly sent fax advertisements to plaintiff to promote its business.

The plaintiff requests a trial by jury and seeks award damages to the plaintiff of $500, enjoin the defendant, all legal fees and any other relief the court deems just. It is represented by Gillian L. Wade and Sara D. Avila of Milstein Adelman Jackson Fairchild & Wade LLP in Los Angeles and Randall K. Pulliam of Carney Bates & Pulliam PLLC in Little Rock, Arkansas.
