Myofunctional Research Co. USA Inc. accused of sending unsolicited junk faxes

SANTA ANA – A San Bernardino County business alleges that a Rancho Cucamonga company sent junk faxes.

Whiting DDS Inc., doing business as Whiting Family Dental, filed a complaint on behalf of all others similarly situated on Oct. 10, in the U.S. District Court for the Central District of California against Myofunctional Research Co. USA Inc. citing the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that Whiting DDS Inc. suffered damages from receiving numerous fax advertisements from the defendant. The plaintiff holds Myofunctional Research Co. USA Inc. responsible because the defendant allegedly sent unsolicited fax advertisements to the plaintiff without permission.

The plaintiff requests a trial by jury and seeks statutory damages, three times statutory damages, injunction against the defendant, all legal fees and any other relief the court grants.
