Woman seeks payment of long-term disability benefits she alleges was wrongfully denied

SAN FRANCISCO – A Cadence employee alleges her claim for long-term disability benefits was wrongfully denied.

Debra Medina filed a complaint on Oct. 12 in the U.S. District Court for the Northern District of California against Liberty Life Assurance Co. of Boston alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on Sept. 13, 2013, while she was employed by Cadence and while the welfare benefit plan was in full force and effect, she became disabled due to various co-morbid and disabling conditions. Despite the fact that she allegedly remains disabled, the defendant terminated her long-term disability benefits on May 21, 2014, and upheld its denial in contrary to the reports and assessments of the doctors who have evaluated and treated plaintiff.

The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly denied plaintiff due process of law and denied benefits under the plan.

The plaintiff seeks judgment against defendant, payment of benefits from May 21, 2014, attorneys’ fees, costs of suit and other relief as the court deems just. She is represented by Brian H. Kim, James P. Keenley and Emily A. Bolt of Bolt Keenley Kim LLP in Berkeley.
