Individual sues financing company over alleged violation of TCPA

OAKLAND — An individual has filed a class-action lawsuit against Ally Financial Inc., a financing company, citing alleged violation of telephone harassment statutes.

Barbara Grant filed a complaint on behalf of all others similarly situated on Oct. 20, in the U.S. District Court for the Northern District of California against Ally Financial, Inc. alleging that the financing company contacted plaintiff several times despite her request to stop calling her in violation of the Telephone Consumer Protection Act (TCPA).

According to the complaint, the plaintiff alleges that she suffered damages from being contacted on her cellular telephone. The plaintiff holds Ally Financial Inc. responsible because the defendant allegedly used an automatic telephone dialing system to call plaintiff's cellular telephone.

The plaintiff requests a trial by jury and seeks statutory damages, injunctive relief, declaratory relief and any other relief this court deems just. She is represented by Trinette G. Kent of Lemberg Law LLC in Wilton, Connecticut.
