CALIFORNIA — Consumers are suing Samsung Electronics America, Inc., and Samsung Electronics Co., Ltd., phone manufacturer, citing alleged breach of implied warranty, design defect and negligence.

Brandon Covert and Jennifer Covert filed a complaint on Oct. 19, in the U.S. District Court for the Northern District of California against the defendants alleging that they manufactured and distributed defective cellphones to consumers.

According to the complaint, the plaintiffs allege that, in Aug. 2, Brandon Covert suffered damages and physical injuries when his smartphone exploded. The plaintiffs hold Samsung Electronics America, Inc. and Samsung Electronics Co., Ltd. responsible because the defendants allegedly failed to properly inspect their phone or make sure that their product is safe for consumers.

The plaintiffs request a trial by jury and seek general damages, economic losses, repair or replacement of destroyed or lost personal property, interest, medical expenses, punitive/exemplary damages, all legal fees and any other relief as this court deems just.
