South Bay Dreams Cooperative sued over unwanted text message sent to minor

SAN DIEGO — A minor has filed a class-action lawsuit against South Bay Dreams Cooperative Inc. d/b/a/ Harbor Collective, a California corporation, citing alleged violation of the Telephone Consumer Protection Act (TCPA).

AG, a minor, filed a complaint individually and on behalf of all others similarly situated on Oct. 19, in the U.S. District Court for the Southern District of California against South Bay Dreams Cooperative Inc. d/b/a/ Harbor Collective alleging that the California corporation violated TCPA by sending intrusive and unwanted text messages.

According to the complaint, the plaintiff alleges that, on May 27, at 9:08 a.m., AG, a minor, received an unwanted telephone solicitation text message from the defendant without the express prior written consent of the plaintiff. The text message was not for emergency purposes but merely to advertise a business-for-profit, thereby causing harm to plaintiff such as costs from his telephone service provider and violation of his privacy rights. 

The plaintiffs hold South Bay Dreams Cooperative Inc. d/b/a/ Harbor Collective responsible because the defendant allegedly caused plaintiff monetary damages including legal fees, and transmitted text messages to recipients without prior expressed invitation or permission in writing or otherwise.

The plaintiffs request a trial by jury and seek judgment in their favor, damages, injunctive relief and other relief the court may deem just. They are represented by Joshua B. Swigart and Veronica E. McKnight of Hyde & Swigart in San Diego and Abbas Kazerounian of Kazerouni Law Group APC in Costa Mesa.
