Pension plan sues Alexander Electric Co. for alleged failure to pay monthly contributions

CALIFORNIA — A labor group is suing M.L. Alexander Electric Co., Inc., a California corporation doing business as Alexander Electric Company, a California corporation, citing alleged breach of contract.

Trustees of the Southern California Ibew-Neca Pension Plan, Trustees of the Southern California Ibew-Neca Defined Contribution Trust Fund; Trustees of the Southern California Ibew-Neca Health Trust Fund, Trustees of the Southern California Ibew-Neca Supplemental Unemployment Benefit Trust Fund, Trustees of the Los Angeles County Electrical Education and Training Trust Fund, Trustees of The National Electric Benefit Fund, Trustees of Southern California Ibew-Neca Labor-Management Cooperation Committee, Trustees of the National Neca-Ibew Labor-Management Cooperation Committee Trust Fund, National Electrical Industry Fund, and Los Angeles Electrical Workers Credit Union filed a complaint on Oct. 17, in the U.S. District Court for the Central District of California against M.L. Alexander Electric Co., Inc., a California corporation doing business as Alexander Electric Co. alleging that the California corporation failed to pay monthly fringe benefit contribution to the labor group.

According to the complaint, the plaintiffs allege that Trustees of the Southern California Ibew-Neca Pension Plan, Trustees of the Southern California Ibew-Neca Defined Contribution Trust Fund; Trustees of the Southern California Ibew-Neca Health Trust Fund, Trustees of the Southern California Ibew-Neca Supplemental Unemployment Benefit Trust Fund, Trustees of the Los Angeles County Electrical Education and Training Trust Fund, Trustees of The National Electric Benefit Fund, Trustees of Southern California Ibew-Neca Labor-Management Cooperation Committee, Trustees of the National Neca-Ibew Labor-Management Cooperation Committee Trust Fund, National Electrical Industry Fund, and Los Angeles Electrical Workers Credit Union suffered damages as the result of unpaid and late paid fringe contributions. The plaintiffs holds M.L. Alexander Electric Co., Inc., a California corporation doing business as Alexander Electric Co. responsible because the defendant allegedly breached their bargaining agreement with plaintiff for failing to pay monthly contributions on behalf of their employees.

The plaintiffs seek unpaid fringe benefit contributions, liquidated damages, damages, interest, all legal fees and interest, to enjoin the defendant, and any other relief as this court deems just. They are represented by Susan Graham Lovelace and Michael Y. Jung of Laquer Urban Clifford & Hodge LLP in Pasadena.
