Zulily named in lawsuit alleging sale of garments with another's copyrighted designs

CALIFORNIA — A California corporation is suing Time Less, Inc., D&H Solutions, LLC, Mode Plus Corp., Rhapsodielle, Inc., Zulily, LLC, Fashion Expo Plus, Genx Clothing, Inc., J. Trendy and DOES 1 through 10, business entities, citing alleged copyright infringement.

Star Fabrics, Inc. filed a complaint on Oct. 19, in the U.S. District Court for the Central District of California against the defendants alleging that they used plaintiff's designs on their products without permission.

According to the complaint, the plaintiff alleges that Star Fabrics, Inc. suffered damages to their business as the result of their designs being used on other garments. The plaintiff holds Time Less, Inc., D&H Solutions, LLC, Mode Plus Corp., Rhapsodielle, Inc., Zulily, LLC, Fashion Expo Plus, Genx Clothing, Inc., J. Trendy and DOES 1 through 10 responsible because the defendants allegedly manufacture garments which consists of fabric that contain plaintiff's designs.

The plaintiff requests a trial by jury and seeks to enjoin the defendant, award of all profits of the defendant to the plaintiff, statutory damages, all legal fees and interest plus any other relief as this court deems just. They are represented by Stephen M. Doniger, Scott A. Burroughs and Howard S. Han of Doniger/Burroughs in Venice.
