Individual sues 9Sparts over alleged trademark infringement of his vehicle racks

CALIFORNIA — An individual is suing 9Sparts Inc., a California corporation, citing alleged unfair competition.

Tailai Ting filed a complaint on Oct. 20, in the U.S. District Court for the Central District of California against 9Sparts Inc. alleging that the California corporation sells vehicle racks that are confusingly similar to plaintiff's products.

According to the complaint, the plaintiff alleges that he suffered damages as the result of his trademark infringement. The plaintiff holds 9Sparts Inc. responsible because the defendant allegedly sells an exact model of plaintiff's Kayak Rack on Amazon.com bearing plaintiff's trademark and even using plaintiff's photographs of the rack.

The plaintiff requests a trial by jury and seeks to enjoin the defendant from further infringing plaintiff's trademark, to order the defendant to recall all infringing products from retailers and distributors, award all damages and profits to the plaintiff, compensatory damages, treble damages, all legal fees and interest, statutory damages and any other relief as this court deems just.
