LOS ANGELES – A Porter Ranch business is accused of not paying employee contributions to several labor union funds.
Trustees of the Southern California IBEW-NECA Pension Plan, trustees of the Southern California IBEW-NECA Defined Contribution Trust Fund; trustees of the Southern California IBEW-NECA Health Trust Fund, et al. filed a complaint on Nov. 1 in the U.S. District Court for the Central District of California against Kingston Electrical Contractor Inc. alleging breach of written collective bargaining agreement and violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late paid contributions from December 2015 to the present. The plaintiffs hold Kingston Electrical Contractor Inc. responsible because the defendant allegedly breached its bargaining agreement with the plaintiffs by failing to make its contributions on behalf of its employees.
The plaintiffs seek unpaid contributions, liquidated damages, damages for breach of contract, all legal fees and interest plus any other relief as the court deems just. They are represented by Susan Graham Lovelace and Michael Y. Jung of Laquer Urban Clifford & Hodge LLP in Pasadena.
