Fabric Selection Inc. alleges copyrighted fabric designs were duplicated

LOS ANGELES – A Los Angeles County company alleges its fabric designs were unlawfully copied and used in clothing.

Fabric Selection Inc. filed a complaint on Nov. 3 in the U.S. District Court for the Central District of California against Karman Inc., Zulily LLC and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that Fit suffered damages to its business. The plaintiff holds Karman Inc., Zulily LLC and Does 1 through 10 responsible because the defendants allegedly continued to use plaintiff's designs on their products despite receiving a cease and desist letter from the plaintiff.

The plaintiff requests a trial by jury and seeks permanent injunction against the defendants, recall and destruction of all infringing garments, award profits and statutory damages to the plaintiff, all legal fees and any other relief as the court deems just.
