LOS ANGELES – A Los Angeles County resident has filed a class-action suit against a North Carolina company over allegations it continued to send text messages after being requested to stop.

Jalen Epps filed a complaint on Nov. 3 in the U.S. District Court for the Central District of California against Earth Fare Inc. and Does 1-10 alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that she suffered damages from receiving several text messages to her cellular telephone. The plaintiff holds Earth Fare Inc., and Does 1-10 responsible because the defendants allegedly used an automatic telephone dialing system to continue to send text messages to her despite her revoking her consent multiple times.

The plaintiff seeks statutory damages, all legal fees and any other relief as the court deems just. She is represented by Scott J. Ferrell and Victoria C. Knowles of Pacific Trial Attorneys APC in Newport Beach.
