Man alleges he is still disabled, LINA wrongfully terminated benefits

Insurance 01

LOS ANGELES – A man formerly employed as a tanker driver alleges his disability benefits were unlawfully terminated.

Samuel Brown filed a complaint on Nov. 4 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he was initially paid disability benefits by the defendant until it terminated the benefits in January 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly denied plaintiff's disability benefits despite having sufficient medical proof to support his claim.

The plaintiff seeks benefits not paid to the plaintiff plus interest, order that the plaintiff is entitled to future disability benefits, all legal fees and any other relief as the court deems just. He is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
