Woman alleges disability claim was denied despite evidence

Insurance 07

SANTA ANA – An Orange County woman alleges her claim for disability benefits was wrongfully denied.

Natalia Farris filed a complaint on Nov. 1 in the U.S. District Court for the Central District of California, Southern Division against Standard Insurance Co., Jacobs Engineering Group Inc., Jacobs Engineering Group Inc. Short Term Disability Plan and Jacobs Engineering Group Inc. Long Term Disability Plan citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on April 29, 2014, while still covered under the disability plans, plaintiff suffered a disability, but despite overwhelming evidence of a covered disability claim, the defendants erroneously continued to uphold its prior determination denying her claim for benefits.

The plaintiff holds Standard Insurance Co., Jacobs Engineering Group Inc., Jacobs Engineering Group Inc. Short Term Disability Plan and Jacobs Engineering Group Inc. Long Term Disability Plan responsible because the defendants allegedly failed to pay disability benefit payments to plaintiff, failed to provide a prompt and reasonable explanation of the basis for the denial of plaintiff’s claims, failed to properly and adequately investigate the merits of plaintiff’s disability claim and failed to provide a full and fair review of plaintiff’s claim.

The plaintiff requests a trial by jury and seeks judgment against defendants, payment of disability benefits, declaratory relief, costs, attorneys' fees, interest and further relief as the court deems just. She is represented by Glenn R. Kantor and Andrew M. Kantor of Kantor & Kantor LLP in Northridge.
