Hestan Commercial Corp. accuses Jade Range of trade dress infringement

LOS ANGELES – An Anaheim kitchen products manufacturer claims a Brea company is using its designs on its appliances.

Hestan Commercial Corp. filed a complaint on Nov. 16 in the U.S. District Court for the Central District of California against Jade Range LLC alleging trade dress infringement and other counts.

According to the complaint, the plaintiff alleges that it designs, markets, sells and distributes cooking and culinary products. It alleges the defendant uses infringing designs on cooking and culinary products in an effort to capitalize on the goodwill and reputation of plaintiff's trade name and in response to customers expressing a preference for plaintiff's designs. The plaintiff holds Jade Range LLC responsible because the defendant allegedly used the same or confusingly similar product design elements and features as those comprising plaintiff's trade dress which caused confusion, mistake and deception.

The plaintiff requests a trial by jury and seeks judgment against the defendant, permanent injunction, account to plaintiff any and all profits derived by infringement, attorneys’ fees, interests, costs, and further relief as the court may deem just. It is represented by Joshua R. Mandell
