LOS ANGELES – Several clothing vendors and retailers are accused of copying a fabric design without permission.

Unicolors Inc. filed a complaint on Nov. 17 in the U.S. District Court for the Central District of California against Kuperhand Inc., individually and doing business as Studio West; Ross Stores Inc.; National Stores Inc., individually and doing business as Factory 2-U; Gordman's Inc.; India Boutique Inc.; M & A Imports LTD, individually and doing business as Just Love; and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Kuperhand Inc., individually and doing business as Studio West; Ross Stores Inc.; National Stores Inc., individually and doing business as Factory 2-U; Gordman's Inc.; India Boutique Inc.; M & A Imports LTD, individually and doing business as Just Love; and Does 1 through 10 responsible because the defendants allegedly copied plaintiff's design TP873 and used it in garments they sold to the public.

The plaintiff requests a trial by jury and seeks to enjoin the defendant from further infringing plaintiff's designs, award all profits to the plaintiff, all damages, interest, all legal fees and any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
