Brand Tarzana Surgical Institute Inc. alleges insurers underpaid caims

Late 03

LOS ANGELES – A surgery center in Tarzana alleges insurers did not adequately reimburse it for services provided.

Brand Tarzana Surgical Institute Inc. filed a complaint on Nov. 21 in the U.S. District Court for the Central District of California against Aetna Inc., Aetna Life Insurance Co., Aetna Life & Casualty (Bermuda) LTD, and Does 1 through 100 citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that it suffered damages due to unpaid and underpaid claims. The plaintiff holds Aetna Inc., Aetna Life Insurance Co., Aetna Life & Casualty (Bermuda) LTD and Does 1 through 100 responsible because the defendants allegedly failed to make payments to the plaintiff for claims made by plaintiff on behalf of individuals insured by the defendants.

The plaintiff seeks damages plus interest, all legal fees and any other relief as the court deems just. It is represented by RIchard D. Williams and Mina Hakakian of Lytton & Williams LLP in Los Angeles.
