Man alleges ceramic wastebasket from Bed Bath & Beyond shattered, injured hand

LOS ANGELES – An Oxnard consumer alleges a ceramic wastebasket caused injuries to his hand.

James P. Sutton filed a complaint on Nov. 23 in the U.S. District Court for the Central District of California against Croscill Home LLC and Bed Bath & Beyond Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 7, 2015, he sustained physical injuries to his left hand and buttocks due to falling on a ceramic wastebasket that was manufactured and sold by the defendants. The plaintiff holds Croscill Home LLC and Bed Bath & Beyond Inc. responsible because the defendants allegedly failed to exercise reasonable care and properly warn the plaintiff regarding the dangerous condition of the wastebasket in the event that it shatters.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, interest and all legal fees.
