Floralship Inc. accused of using copyrighted photos on website

LOS ANGELES – A Laguna Beach flower company is accused of using a Georgia company's photos on its website.

Online Flower Search LLC filed a complaint on Nov. 23 in the U.S. District Court for the Central District of California, Western Division against Floralship Inc. and Charles M. Jackson alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to their business. The plaintiff holds Floralship Inc. and Jackson responsible because the defendants allegedly used plaintiff's images on its website to advertise its products.

The plaintiff seeks enjoin the defendant from further infringing plaintiff's copyrights, damages, profits, statutory damages of not less than $750 and not more than $150,000 for each infringed image, order the defendant to deliver up for destruction all infringing materials, all legal fees and any other relief as the court deems just. It is represented by Don A. Hernandez of Zuber Lawler & Del Duca LLP in Los Angeles.
