Diamond Resorts Corp. employee alleges claim for disability benefits was wrongfully denied

LOS ANGELES – A woman alleges she is disabled from an on-the-job accident and that her claim for disability benefits was wrongfully denied.

Kim Hiller filed a complaint on Nov. 23 in the U.S. District Court for the Central District of California, Eastern Division against Liberty Assurance Co. of Boston and Diamond Resorts Corp. Health and Welfare Plan citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2015, she became disabled due to an accident she experienced during her employment. The plaintiff holds Liberty Assurance Company of Boston and Diamond Resorts Corp. Health and Welfare Plan responsible because the defendants allegedly upheld their decision to deny plaintiff's benefits despite having sufficient medical proof to support her claim.

The plaintiff seeks award benefits to the plaintiff plus interest, declare that the plaintiff is eligible to receive further benefits for as long as she remains disabled, all legal fees and any other relief as this court deems just. She is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
