Crescent City Harbor District alleges it is owed by vessel, owner for fees

SAN FRANCISCO – The owner of a fishing vessel is facing a suit from a harbor district over allegations that it failed to pay permit fees.

Crescent City Harbor District filed a complaint on Nov. 23 in the U.S. District Court for the Northern District of California against F/V Chelsea and John F. Marques alleging failure to pay.

According to the complaint, the plaintiff alleges that on Oct. 1, 2009, it entered into a berthing permit and rental agreement with Marques for berthing the vessel Chelsea, the agreement provides for berthage fees and related charges on a semi-annual or annual basis. The suit states that in summer of 2013, Marques began falling behind in his berthing fees with total balance due of more than $8,747.48 for the past three years. The plaintiff holds the Chelsea and Marques responsible because the defendants allegedly failed to fulfill their obligations under the agreement to pay the necessary berthing and rental fees, and caused plaintiff to retain and pay for counsel.

The plaintiff requests a trial by jury and seeks judgment against defendant for sum of $8,747.48, warrant for arrest of the defendant vessel, to condemn and sell vessel, proceeds of sale, defendant to pay any deficiency remaining and further relief as is just.
