D&A Services accused of violating laws when attempting to collect alleged debt

SAN DIEGO – An individual claims a San Diego County debt collector tried to collect a higher amount for an alleged debt that what was actually owed.

Mohammed Salehi filed a complaint on Nov. 22 in the U.S. District Court for the Southern District of California against D & A Services LLC alleging that the collection agency violated the Federal Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collections Practice Act.

According to the complaint, the plaintiff alleges that after June 15, he received a collection notice from the defendant stating that he owed a debt in the amount of $8,169.96 to Bank of America. The suit states that the statute of limitation of the loan has expired and the notice failed to state the fact, more so, it reflected an erroneous amount. The plaintiff alleges his counsel sent a letter to defendant disputing the debt and requesting a verification of the debt, as a result, plaintiff has incurred additional actual damages to retail counsel and suffered from worry, emotional distress, anxiety and humiliation.

The plaintiff holds D & A Services LLC responsible because the defendant allegedly attempted to collect a higher amount in its validation notice and failed to mention that the statute of the limitation of the loan has expired.

The plaintiff requests a trial by jury and seeks statutory damages, attorneys’ fees, costs of suit, interest and further relief as the court may deem proper. He is represented by Alex Asil Mashiri of Mashiri Law Firm in San Diego.
