Amalfi Decor LLC claims cake, cupcake stands do not infringe Opulent Treasures patent

LOS ANGELES – A Torrance home decor company is seeking relief regarding infringement claims made by a Segundo business.

Amalfi Decor LLC filed a complaint on Nov. 28 in the U.S. District Court for the Central District of California, Western Division against Opulent Treasures Inc., Carol Wilson and Does 1 to 10 seeking declaratory relief.

According to the complaint, the plaintiff alleges that it suffered damages from being accused of copyright infringement by the defendants. The plaintiff holds Opulent Treasures Inc., Carol Wilson and Does 1 to 10 responsible because the defendants allegedly made false claims that the plaintiff is infringing their design of cake stand and cupcake holder.

The plaintiff requests a trial by jury and seeks for damages due to lost sales, damages due to loss of business reputation, punitive damages, disgorgement, all legal fees and interest plus any other relief as the court deems just. It is represented by Michael E. Lopez, Joseph R. Wilbert and Caroline S. Scala of Wilbert Bark LLP in Irvine.
