LOS ANGELES – A consumer alleges that that a New York-based retailer misleads consumers by advertising that its items are for sale at a reduced price.

Dana Delman filed a complaint on behalf of all others similarly situated on Dec. 13 in the U.S. District Court for the Central District of California against J. Crew Group Inc., J. Crew International Inc. and Millard Drexler alleging violation of the False Advertising Law, Unfair Competition Law and other counts.

According to the complaint, the plaintiff alleges that she suffered damages from being misled into purchasing a product that was advertised as on sale. The plaintiff holds J. Crew Group Inc., J. Crew International Inc., and Millard Drexler responsible because the defendants allegedly claimed that the prices of their items on the J. Crew Factory website are discounted when the items are actually being sold at retail prices.

The plaintiff requests a trial by jury and seeks compensatory damages, interest, injunction, all legal fees and reimbursement plus any other relief as the court deems just. She is represented by David N. Lake of The Law Offices of David N. Lake in Encino and by representatives of Roy Jacobs & Associates in New York and The Paskowitz Law Firm in New York.
