Independent Rebar alleged to have breached bargaining agreement with union funds

LOS ANGELES – Several union labor trusts are seeking more than $45,000 for allegedly unpaid contributions from a California employer.

Board of Trustees of the California Ironworkers Field Pension Trust, Board of Trustees of the California Ironworkers Field Welfare Plan, et al. filed a complaint on Dec. 14 in the U.S. District Court for the Central District of California against Dominic Ignacio Burriel, doing business as Independent Rebar alleging breach of written collective bargaining agreement and violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages due to late and unpaid contributions from May to September. The plaintiffs hold Ignacio Burriel responsible because the defendant allegedly breached his agreement with the plaintiffs by failing to pay fringe benefit contribution on behalf of his employees.

The plaintiffs seek unpaid contributions of $45,392.55, liquidated damages of $9,704.82, interest of $962.16, order the defendant to submit his records, audit expenses, all legal fees and any other relief as the court deems just. They are represented by Kerry K. Fennelly and Valentina S. Mindirgasova of Cornwell & Baldwin in Escondido.
