Urban Textile claims garment vendors used fabric design in clothing without permission

LOS ANGELES – A Los Angeles corporation alleges that two companies unlawfully copied its design and incorporated it on their fabrics.

Urban Textile Inc. filed a complaint on Dec. 15 in the U.S. District Court for the Central District of California against Blue Heart LLC, Ross Stores Inc., doing business as DD's Discounts, and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it is the owner of a textile design known as UB-4815. The plaintiff holds Blue Heart LLC, Ross Stores Inc., doing business as DD's Discounts, and Does 1-10 responsible because the defendants allegedly distributed garments that feature fabrics that bear plaintiff's two dimensional design.

The plaintiff requests a trial by jury and seeks enjoin the defendants, all profits, statutory damages, all legal fees and interest plus any other relief as the court deems just. It is represented by C. Yong Jeong and Amy Choe of Jeong & Likens LC in Los Angeles.
