Midnight Rider Inc. files suit over alleged counterfeit clothing

LOS ANGELES – A Los Angeles clothing brand that sells high-end graphic T-shirts claims counterfeit versions of its clothes are being sold.

Midnight Rider Inc. filed a complaint on Dec. 16 in the U.S. District Court for the Central District of California against Forever 21 Inc., Project 28 Clothing and Does 1-10 alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that Midnight Rider Inc. suffered damages to its business. The plaintiff holds Forever 21 Inc., Project 28 Clothing and Does 1-10 responsible because the defendants allegedly sells unauthorized and counterfeit copies of plaintiff's garments without permission.

The plaintiff requests a trial by jury and seeks damages, statutory damages, all profits, actual damages, treble damages, punitive damages, all legal fees and any other relief as the court deems just. It is represented by Stephen M. Doniger and Scott A. Burroughs of Doniger/Burroughs in Venice.
