Nightcap Clothing claims For Love and Lemons is using mark without permission

LOS ANGELES – A high-end clothing designer claims a competitor is using its mark to advertise its brand.

Nightcap Clothing Inc. filed a complaint on Dec. 16 in the U.S. District Court for the Central District of California, Western Division against For Love and Lemons LLC and Does 1 to 10 alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it has suffered damages to its business. The plaintiff holds For Love and Lemons LLC and Does 1 to 10 responsible because the defendants allegedly used plaintiff's Nightcap mark on its website, email, Instagram and others to advertise its products.

The plaintiff seeks enjoin the defendant from further infringing plaintiff's trademark, deliver up for destruction all infringing materials, all profits, punitive and exemplary damages, interest, all legal fees and any other relief as the court deems just.
