Former Office Max employee claims Prudential wrongfully denied disability benefits claim

LOS ANGELES – An East Lancaster woman formerly employed by Office Max alleges her claims for disability benefits were wrongfully denied.

Lin Peterson filed a complaint on Dec. 19 in the U.S. District Court for the Central District of California against Prudential Insurance Co. of America and Does 1 to 10 citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she became disabled due to several health problems, including dyspnea and respiratory abnormalities, and applied for disability benefits but was denied by the defendant. The plaintiff holds Prudential Insurance Co. of America and Does 1 to 10 responsible because the defendants allegedly upheld their decision to deny plaintiff's claim for disability benefits despite being disabled according to the terms of the policy.

The plaintiff seeks payment of monthly benefits at the rate of $463 per week from September 2014 until December 2015, long-term disability benefits at the rate of 60 percent of plaintiff's earnings of $2,550 per month, interest, all legal fees and any other relief as the court deems just. She is represented by Bernard R. Schwam of Law Office of Bernard R. Schwam in Encino.
