LOS ANGELES – A California contractor and its officers are accused of failing to pay contributions to labor union funds on behalf of their employees.

Carpenters Southwest Administrative Corp. and the board of trustees for the Carpenters Southwest Trusts filed a complaint on Dec. 20 in the U.S. District Court for the Central District of California, Western Division against Pre Con Industries Inc., doing business as Premier Drywall; James Amburgey; John Hester Amburgey; Maria Rocio Amburgey; and Does 1 through 10 citing the Labor Management Relations Act and the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they suffered damages due to unpaid and late-paid benefit contributions. The plaintiffs holds Pre Con Industries Inc., doing business as Premier Drywall; James Amburgey; John Hester Amburgey; Maria Rocio Amburgey; and Does 1 through 10 responsible because the defendants allegedly breached their bargaining agreement with the plaintiffs by failing to pay benefit contributions on behalf of their employees.

The plaintiffs seek unpaid contributions of $20,056.14 plus interest and liquidated damages, audit costs, statutory damages, funds withheld from employees in the sum of $5,367.68 plus interest, all legal fees and any other relief as the court deems just. They are represented by Thomas Davis and Jodi Siegner of DeCarlo & Shanley in Los Angeles.
