Patient alleges esophagus was injured during surgery at veterans hospital

LOS ANGELES – A man alleges he was injured during surgery at a Veterans Affairs hospital in Loma Linda.

Manuel De La Cruz filed a complaint on Dec. 22 in the U.S. District Court for the Central District of California, Western Division against Veterans' Affairs Hospital Medical Center; Jason Wallen, M.D.; Does 1 through XX inclusive; Doe Companies 1 through XX inclusive and Doe corporations 1 through XX inclusive alleging negligence.

According to the complaint, the plaintiff alleges that his esophagus was perforated during surgery on Dec. 29, 2014, while under the defendants' care. The plaintiff holds Veterans' Affairs Hospital Medical Center, Wallen, Does 1 through XX inclusive; Doe Companies 1 through XX inclusive and Doe corporations 1 through XX inclusive responsible because the defendants allegedly unprofessionally performed their services and that the injury was not discovered for two weeks.

The plaintiff seeks general damages, medical expenses, all legal fees and any other relief as the court deems just. He is represented by Keith N. Daley of Dixon & Daley LLP in Santa Fe Springs.
