Standards Fabrics International claims Kmart, others unlawfully used fabric design

LOS ANGELES – Kmart and the Joe Boxer brand are some of the defendants named in a copyright infringement suit by a Los Angeles County business.

Standard Fabrics International, Inc. filed a complaint on Dec. 21 in the U.S. District Court for the Central District of California against Project 28 Clothing LLC; Iconix Brand Group Inc., doing business as Joe Boxer; Kmart Corp.; and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Project 28 Clothing LLC; Iconix Brand Group Inc., doing business as Joe Boxer; Kmart Corp.; and Does 1-10 responsible because the defendants allegedly distributes garments that feature plaintiff's design 7866.

The plaintiff requests a trial by jury and seeks enjoin the defendant, award all profits and other monetary advantages, all legal fees plus interest and any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
