SAN FRANCISCO – A Pennsylvania stock photography agency claims a publisher used its photographs without permission.

Grant Heilman Photography Inc. filed a complaint on Dec. 23 in the U.S. District Court for the Northern District of California against McGraw-Hill Global Education Holdings LLC and McGraw-Hill School Education Holdings LLC alleging copyright infringement.

According to the complaint, the plaintiff alleges that it owns copyrights for certain photographic images registered with the United States Copyright Office and that the defendants used its works in at least 18 of its programs without authorization. The plaintiff holds McGraw-Hill Global Education Holdings LLC and McGraw-Hill School Education Holdings LLC responsible because the defendants allegedly failed to obtain license to use subject photographs.

The plaintiff requests a trial by jury and seeks preliminary and permanent injunction, impoundment of all infringing copies, actual damages and all profits derived from unauthorized use, attorneys’ fees, costs, expert witness fees, interest and further relief as the court deems just. It is represented by Christopher Seidman of Harmon & Seidman LLC in Grand Junction, Colorado; Amanda L. Bruss of Harmon & Seidman LLC in Denver, Colorado; and Alex Rice Kerr of Harmon & Seidman LLC in Jackson, Wyoming.
