LOS ANGELES – An employer is alleged to owe more than $650,000 in unpaid contributions to a labor union.

Carpenters Southwest Administrative Corp. and board of trustees for the Carpenters Southwest Trust filed a complaint on Jan. 11 in the U.S. District Court for the Central District of California, Western Division against Towne Construction Inc.; Thomas Michael Towne, also known as Tom Towne; Marc Towne; American Contractors Indemnity Co. and Does 1 through 10 citing the Labor-Management Relations Act.

According to the complaint, the plaintiffs allege that they suffered damages from unpaid and late-paid fringe benefit contributions. The plaintiffs holds Towne Construction Inc.; Thomas Michael Towne, also known as Tom Towne; Marc Towne; American Contractors Indemnity Co. and Does 1 through 10 responsible because the defendants allegedly breached their bargaining agreement with the plaintiff by failing to make their monthly contributions on behalf of their employees.

The plaintiffs seek unpaid contributions in the sum of $653,161.04, interest and liquidated damages, funds withheld from the vacation plan in the sum of $135,906.44, unpaid contributions of $4,000 plus interest on a bond, all legal fees and any other relief as the court deems just. They are represented by Jodi Siegner of DeCarlo & Shanley in Los Angeles.
