Woman files suit against Citibank over alleged frequency of collection calls

LOS ANGELES – A Panorama City resident alleges a debt collector called her hundreds of times in a four-month period.

Rubi Arias filed a complaint on Jan. 11 in the U.S. District Court for the Central District of California against Citibank NA and Does 1 through 10 citing the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that she suffered damages from receiving 231 calls from the defendants from July 16, 2016, to Nov. 16, 2016, in their attempt to collect an alleged debt. The plaintiff holds Citibank NA and Does 1 through 10 responsible because the defendants allegedly continued to call the plaintiff despite her several requests to stop calling her.

The plaintiff requests a trial by jury and seeks injunction against the defendant, $500 in statutory damages, $1,500 in treble damages, all legal fees plus interest and any other relief as the court deems just. She is represented by Kian Mottahedeh and John D. Sarai of SM Law Group, APC in Encino.
