Meyer Corp. US claims Swiss Made Brands is infringing Prestige mark

SAN FRANCISCO – A cookware manufacturer alleges another company is using its mark to sell kitchenware.

Meyer Corp. US and Meyer Intellectual Properties Limited filed a complaint on Jan. 4 in the U.S. District Court for the Northern District of California against Swiss Made Brands USA Inc., doing business as Swiss Diamond USA, alleging trademark infringement and other counts.

According to the complaint, the plaintiffs allege that they have suffered and continue to suffer irreparable harm and economic injury as a result of defendant's infringement of plaintiffs' registered trademark Prestige for its cookware products. The plaintiffs hold Swiss Made Brands USA Inc. responsible because the defendant allegedly is likely to cause confusion or deception as to its affiliation, connection, or association with plaintiffs and their products and capitalized and received the benefit of plaintiff's reputation and goodwill.

The plaintiffs request a trial by jury and seek judgment against defendant, enjoinment from further infringement, actual damages, profits, attorneys’ fees, costs of suit, prejudgment interest, treble and punitive damages, and further relief the court deems appropriate. They are represented by Robert N. Phillips, Seth B. Herring and Christopher J. Pulido of Reed Smith LLP in San Francisco.
