SANTA ANA – An Orange County business claims a Beverly Hills company sent it unsolicited fax advertisements.

Ryoo Dental Inc. filed a complaint on behalf of all others similarly situated on Jan. 20 in the U.S. District Court for the Central District of California, Southern Division against the Keivan Sarraf, DDS Inc., doing business as Kairos Dental Laboratory and Kairos Dental Lab; and Keivan Sarraf, DDS citing the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that it suffered damages from receiving unsolicited advertisement fax messages from the defendants. The plaintiff holds Keivan Sarraf, DDS Inc. and Sarraf responsible because the defendants allegedly failed to include an opt-out option to their advertisements and did not have the plaintiff's permission to send the faxes.

The plaintiff requests a trial by jury and seeks statutory damages, injunction against the defendants, all legal fees and any other relief as the court deems just. It is represented by Seth M. Lehrman of Farmer, Jaffe, Weissing, Edwards, Fistos & Lehrman PL in Fort Lauderdale, Florida.
