Woman seeks disability benefits from Unum Life Insurance Co.

LOS ANGELES – A Los Angeles County woman formerly employed by Donaldson Filtration Systems alleges her claim for disability benefits was wrongfully denied by her insurer.

Kathleen Lemon filed a complaint on Jan. 24 in the U.S. District Court for the Central District of California against Unum Life Insurance Co. of America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in May 2015, she became disabled due to fibromyalgia and applied for disability benefits, but was denied on March 17, 2016. The plaintiff holds Unum Life Insurance Co. of America responsible because the defendant allegedly denied plaintiff's application for disability benefits based on its claim that there are no objective tests that established fibromyalgia on plaintiff.

The plaintiff seeks damages, disability benefits payable at the rate of $4,899 per month plus interest, and any other relief as the court deems just. She is represented by Bernard R. Schwam of Law Office of Bernard R. Schwam in Encino.
