Consumer alleges Chase Bank USA NA caused damages with frequent calls

SAN DIEGO – A San Diego man alleges a debt collection continued to call him after he revoked his consent.

Joseph Megow filed a complaint on Jan. 19 in the U.S. District Court for the Southern District of California against Chase Bank USA NA alleging violation of the Telephone Consumer Protection Act and the Rosenthal Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that beginning in December 2015, the defendant called him numerous times in its attempt to collect on an alleged debt. The plaintiff holds Chase Bank USA NA responsible because the defendant allegedly continued to call the plaintiff after he asked him to stop and used an automatic dialer to call him without his express consent.

The plaintiff requests a trial by jury and seeks judgment against defendant, statutory damages of $500 per call, treble damages of $1,500 per call, actual damages, injunctive relief, costs of litigation, attorney’s fees, and further relief as may be just.
