Man alleges he is owed disability benefits

LOS ANGELES – A man claims his disability benefits were unlawfully terminated and seeks payment of the benefits.

John Vigil filed a complaint on Jan. 25 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in March 2013, he became disabled and was initially paid disability benefits until his claim was terminated in June 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld its decision to deny plaintiff's disability benefits despite still being disabled according to the terms of the plan.

The plaintiff seeks award benefits due to him plus interest, determine that the plaintiff is eligible for future disability benefits, all legal fees and any other relief as the court deems just. He is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
