SAN DIEGO – A Ramona company is accused of performing copyright music after a license had been terminated.
WB Music Corp., Jordan Rocks Music, Experience Hendrix LLC and Herbilicious Music filed a complaint on Jan. 31 in the U.S. District Court for the Southern District of California against Premium Development LLC and Orrin Day alleging copyright infringement.
According to the complaint, the plaintiffs are members of the American Society of Composers, Authors and Publishers and that the defendants entered into an agreement with ASCAP in 2010 for a license. The suit states the license was terminated in September 2015 because the defendants failed to pay license fees.
The plaintiffs hold Premium Development LLC and Day responsible because the defendants allegedly continued to perform the plaintiffs' music at Ramona Main Stage without permission.
The plaintiffs seek judgment in their favor, restrain from further infringement, statutory damages of no more than $30,000 or less than $750 for every violation, costs of action, attorneys' fees, and further relief as may be just.
