Redwood City man claims Daly City officer used excessive force

SAN FRANCISCO – A Redwood City man alleges he suffers from permanent nerve damage after his arm was shot by a Daly City police officer.

Shikeb Saddozai filed a complaint on Feb. 3 in the U.S. District Court for the Northern District of California against Peter Nelson, individually in his official capacity, city of Daly City, and Does 1 to 10 alleging assault, failure to train and other counts.

According to the complaint, Nelson was dispatched to investigate a disturbance on Feb. 8, 2016, and fired his service pistol to disarm the plaintiff. The suit states that the plaintiff was sitting on the ground with his hands raised and was unarmed during this incident. The plaintiff alleges he was shot in the forearm and this has caused permanent nerve damage. He alleges in the suit that such an action was excessive because Nelson had no reason to believe that he was dangerous.

 The plaintiff holds Nelson, individually in his official capacity and the city of Daly City and Does 1 to 10 responsible because the defendants allegedly used excessive force to arrest him, committed assault and battery with a deadly weapon and failed to provide proper supervision and training to its officers.

The plaintiff requests a trial by jury and seeks judgment against the defendants, jointly and severally, for actual damages, costs, expenses and all other relief to which plaintiff is justly entitled. He is represented by Robert G. Howie and Audrey Smith of Howie and Smith LLP in San Mateo.
