OAKLAND – A Concord registered nurse claims her insurer has wrongfully denied her long-term disability benefits claims.
Karen Tomlinson filed a complaint on Feb. 2 in the U.S. District Court for the Northern District of California, Oakland Division against Metropolitan Life Insurance Co., Kaiser Foundation Health Plan Inc. Long-Term Disability Plan and the Kaiser Foundation Health Inc. Long-Term Disability Plan alleging that they violated the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she suffers from chronic Lyme disease and chronic fatigue syndrome. The suit states plaintiff applied numerous times for long-term disability benefits and was denied each and every time. The plaintiff holds defendants responsible because the plan administrators allegedly failed to provide her benefits under the terms of long-term disability plan and failed to provide sufficient investigation of her claims even after submitting enough information and timely appeals.
The plaintiff requests a trial by jury and seeks award for long-term disability benefits, costs of the action and for all such other relief as the court deems appropriate and equitable.
