SAN DIEGO – Two San Diego County men formerly employed as drivers claims their employers violated labor laws.

William Steve Valencia and Luis Fernandez filed a complaint on behalf of others similarly situated on Feb. 8 in the U.S. District Court for the Southern District of California against North Star Gas LTD Co. and Peoplease LLC citing the Fair Labor Standards Act and state laws.

According to the complaint, the plaintiffs allege that William Steve Valencia and Luis Fernandez worked for more than 40 hours without being paid minimum or overtime wages. The plaintiffs hold North Star Gas LTD Co. and Peoplease LLC, responsible because the defendants also allegedly failed to provide adequate wage statements.

The plaintiffs request a trial by jury and seek consequential damages, liquidated damages, enjoin the defendants, restitution, actual damages, interest, all legal fees and any other relief as the court deems just. They are represented by Craig M. Nicholas, Alex Tomasevic and Shaun Markley of Nicholas & Tomasevic LLP in San Diego.
