Ion Solar alleged to have unlawfully called consumer for marketing purposes

SAN DIEGO – A Utah company is facing a suit from a San Diego County man over its alleged solicitation calls.

Erik Knutson filed a complaint on behalf of all others similarly situated on Feb. 10 in the U.S. District Court for the Southern District of California against Ion Solar LLC alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in January 2013, he suffered damages from the defendant's solicitation calls marketing solar equipment. The plaintiff holds Ion Solar LLC responsible because the defendant allegedly kept on calling the plaintiff's cellular telephone using an automatic telephone dialing system without his prior consent.

The plaintiff requests a trial by jury and seeks $500 in statutory damages, $1,500 in treble damages, and any other relief as the court deems just. He is represented by Joshua Swigart and Kevin Lemieux of Hyde & Swigart in San Diego and by Abbas Kazerounian of Kazerouni Law Group in Costa Mesta.
