Storm Management employee claims insurer wrongfully terminated benefits

Insurance 01

LOS ANGELES – A Los Angeles County woman alleges her disability benefits were wrongfully terminated.

Rose Buscemi filed a complaint on Feb. 7 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America and Storm Management Inc. Long Term Disability Plan citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in May 2015, she became disabled and was initially approved to receive disability benefits but the benefits were later terminated. The plaintiff holds Life Insurance Co. of North America and Storm Management Inc. Long Term Disability Plan responsible because the defendants allegedly upheld their decision to deny plaintiff's disability benefits and did not provide a full and fair review of her claim.

The plaintiff seeks payment of disability benefits, reinstatement, all legal fees, interest, and any other relief as the court deems just. She is represented by Glenn R. Kantor and Andrew M. Kantor of Kantor & Kantor LLP in Northridge.
