Alien Vape mark owner claims Big Bang Vape Co. is infringing mark

LOS ANGELES – An electronic cigarette distributor claims another company is unlawfully using its trademark.

Mark Sarieddine filed a complaint on Feb. 7 in the U.S. District Court for the Central District of California against Big Bang Vape Co. LLC, Taylor Craig and Does 1 through 10 alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that he has been selling electronic cigarettes and liquid under the Alien Vape trademark. The plaintiff holds Big Bang Vape Co. LLC, Craig and Does 1 through 10 responsible because the defendants allegedly advertised their Alien Kiss and other products using plaintiff's marks.

The plaintiff requests a trial by jury and seeks injunction against the defendant from using plaintiff's marks, order the destruction of all infringing materials, profits and damages, treble damages, exemplary or punitive damages, all legal fees, interest and any other relief as the court deems just. He is represented by Paulo A. De Almeida and Alex D. Patel of Patel & Almeida PC in Encino.
