LOS ANGELES – A pension plan alleges an inactive corporation has defaulted on a payment obligation.

GCIU-Employer Retirement Fund and board of trustees of the GCIU-Employer Retirement Fund filed a complaint on Feb. 8 in the U.S. District Court for the Central District of California, Western Division against Western Printing Ink Corp. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that GCIU-Employer Retirement Fund and Board of Trustees of the GCIU-Employer Retirement Fund suffered damages due to unpaid withdrawal liability. The plaintiffs hold Western Printing Ink Corp. responsible because the defendant allegedly withdraw its participation from the labor group fund but failed to pay its withdrawal liability.

The plaintiffs seek withdrawal liability of $585,091, interest, all legal fees, an audit of the defendant's books, liquidated damages and interest. They are represented by Kerry K. Fennelly and Valentina S. Mindirgasova of Cornwell & Baldwin in Escondido.
